The terms and conditions governing use of TopSpells USA’s website and spiritual services.
Please read these Terms of Service (“Terms”) carefully before using topspellsusa.com or engaging any services offered by TopSpells USA (“Company,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By using this website or booking any service, you confirm that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you may not use our website or services.
2. Nature of Services
TopSpells USA provides spiritual consulting and spell casting services grounded in Senegalese ancestral tradition, rooted in the Serer and Wolof spiritual line. These services are offered:
- For entertainment and spiritual guidance purposes
- Without any guarantee of specific outcomes or results
- As a supplement to, not a replacement for, professional medical, legal, or psychological counsel
Baba Ali reserves the right to decline any service request that conflicts with his ethical standards, including requests he believes are intended to harm another person.
3. Eligibility
You must be at least 18 years of age to use our services or website. By using our services, you represent and warrant that you are 18 or older and legally capable of entering into binding contracts.
4. Payment & Fees
No Casting Fee
Per Baba Ali’s sacred custom, there is no fee for the spell casting itself. Clients cover only the cost of the ritual materials their specific working requires, and that cost is confirmed before any work begins. If a working does not bring results, materials are refunded in full.
Payment Methods
We accept credit/debit cards, Zelle, PayPal, Cash App, and bank transfer for materials costs. Materials are paid for before a casting begins, unless a split payment arrangement is agreed upon in writing.
Disputes
Any payment disputes must be raised within 14 days of service delivery. Chargebacks initiated without first contacting us constitute a breach of these Terms.
Cancellations & Refunds
Full cancellation deadlines, reschedule rules, and refund eligibility are set out in our Refund & Cancellation Policy, which forms part of these Terms. In summary: materials not yet purchased are fully refundable, and if a casting does not bring results within the standard window, the materials cost is refunded in full.
5. Client Conduct
By engaging our services, you agree to:
- Provide accurate and truthful information during intake and consultations
- Use our services only for lawful purposes
- Not attempt to harm, threaten, or coerce any third party through spiritual services
- Maintain confidentiality regarding the specifics of your casting
- Not harass, abuse, or make unreasonable demands of Baba Ali or any staff
We reserve the right to terminate services and refuse refunds in cases of abusive conduct, fraudulent claims, or violation of these Terms.
6. Intellectual Property
All content on topspellsusa.com — including text, images, videos, and design — is the property of TopSpells USA and protected by applicable copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Disclaimer of Warranties
Our website and services are provided “as is” without warranties of any kind, express or implied. We do not warrant that our website will be error-free, uninterrupted, or free of viruses. Spiritual services are offered without warranty of outcome.
8. Limitation of Liability
To the maximum extent permitted by law, TopSpells USA and Baba Ali shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website. Our maximum aggregate liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
9. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Harris County, Texas.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes are effective upon posting to this page. Continued use of our services after changes constitutes your acceptance of the updated Terms.
